Terms and Condition
1. The “CUCKOO E-Brandshop TIKTOK Shop CUCKOO Red Flask. GWP will start on the 24th December 2024 and end on 27th of December 2024 at 23:59:59 PM GMT+8 (“GWP Period”). CUCKOO International (MAL) Berhad. [Co. No. 201401026804 (1102894-H)] (“Organiser”) shall reserve the absolute right to shorten or extend the Giveaway Period without prior notice. Any purchases made outside the Giveaway Period will not be eligible for participation and will not be entertained by the organisation.
2. This GWP Terms and Conditions (“Terms”) shall apply to this GWP. By participating in this GWP you hereby agree to be bound by these Terms.
3. This GWP is open to all individuals who are 18 years of age and above at the time the GWP Period commences (“Participants”). This GWP is not open to: a. Employees of the Organiser (including prospective employees and/or related companies) and their immediate family members (children, parents, siblings, and spouse); and/or b. Representatives of the Organiser, employees and/or advertising agencies and/or promotional service coordinators (including prospective employees and/or related companies,) and immediate family members (children, parents, siblings, and spouse).
GWP Mechanics
Any purchase of CUCKOO Rice Cooker will be given a CUCKOO Red Flask as a GWP
To participate in the GWP:
a. Visit the CUCKOO E-Brandshop TikTok shop (https://www.tiktok.com/@cuckoomy) and purchase any of the following products:
● CUCKOO CR-0675F RICE COOKER
● CUCKOO CR-1020F RICE COOKER
● CUCKOO CR-1713 RICE COOKER.
● CR-1005 RICE COOKER
● CR-1050F RICE COOKER
● CR-1095 COOKER (collectively referred to as “Eligible Products”)
(collectively referred to as “Eligible Products”)
b. For each Eligible Product added to your cart, one (1) CUCKOO Red Flask will be automatically included.
c. Upon successful completion of your purchase, the ticket will be delivered along with your purchased product within three (3) working days.
d. CUCKOO Red Flask will be distributed on a first-come, first-served basis, based on the order in which participants complete their purchases.
e. CUCKOO Red Flask obtained through this Giveaway have no cash value and cannot be exchanges for cash or any other form of consideration.
6. The Organiser reserves the right to substitute for the CUCKOO Red Flask without prior notice. The CUCKOO Red Flask are not transferable, refundable, or exchangeable in any other form for whatever reason. All tickets are given on an “as is” basis.
7. All entries become the property of the Organiser.
8. Individuals are required to produce proof of identity during and prior to CUCKOO Red Flask redemption for the purpose of identity verification. The only forms of proof of identity accepted by the Organiser are the Malaysian Identity card, Driver’s license and/or Passports. The Organiser has every right to disqualify the individuals should the individuals fail to provide any proof of identity as required by the Organiser.
9. By participating in this GWP, you hereby agree and authorise the Organiser and its subsidiaries (“the Group”) to collect, use, process and/or disclose your personal data, as provided, for the facilitation of your participation in, and our administration of the GWP; and to conduct marketing, including contacting and/or sending you information, advertisements, invitations, and other promotional materials related to the Group’s product, services, initiatives, and events through post, phone, e-mail and other forms of electronic communication as the Group deems fit and proper in accordance with the Personal Data Protection Act 2010 and our Privacy Notice available at our website. Please visit our website for further details on the Privacy Notice, including how you may access and correct your personal data, withdraw/limit consent of the processing of your personal data or prevent the processing of your personal data for direct marketing purposes.
10. The Organiser reserves the sole and absolute right to withdraw, amend, omit and/or vary any part or the whole of the Terms without prior notice to you and you shall be bound to observe, perform, and comply with the Terms herein and any amendments thereof.
11. The Organiser shall be entitled to take any form of action against any person or entity who abuses the Giveaway, including but not limited to, any suspicious activities or any attempts to circumvent the Terms herein.
12. The Organiser is not responsible or liable for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorised access to, or alteration of, user or member communications, or any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail on account of technical problems or traffic congestion on the internet and/or websites.
13. Participants of the GWP shall assume full liability and responsibility in case of any accident, injury, damage, or claim resulting from participation in this GWP.
14. You acknowledge and agree that the Organiser reserves the absolute rights to disqualify your participation in the GWP if: i) you are found or suspected of tampering with the GWP mechanics or the operation of the GWP; ii) you are found or suspected of undertaking fraudulent activities or other activities that are harmful to the Giveaway; or iii) you are in breach of the Terms. Notwithstanding the foregoing, the Organiser reserves the right to reject the participation of any person or entity in the GWP at its sole and absolute discretion without assigning any reasons whatsoever.
15. The Organiser shall not take any responsibility in the event you are prevented from participating in the GWP, as a result of certain technical restrictions or other limitations specifics or due to force majeure which, including but not limited to, regulatory and/or government directive, act of God, strikes, accidents, terrorism, epidemic, pandemic, civil or military disturbances, natural catastrophes, interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services.
16. The Organiser’s decision in any matter in relation to the GWP shall be deemed as final and conclusive. No further correspondence will be entertained by the Organiser.
17. In the event of any discrepancy between the Terms herein as compared to the advertising, promotional, publicity and other materials relating to or in connection with the GWP, the Terms on the GWP Platform shall prevail.
18. These Terms shall be governed by the laws of Malaysia and any dispute arising out of or in connection with the GWP shall be referred to the exclusive jurisdiction of courts in Malaysia.
19. This is an electronic document and does not require any digital or physical signature.
